Is it legal to use a personal Premium Deezer account at work?


Hi,

I have two questions:

  1. Is it permitted to listen to a personal Premium Deezer account at the office using headphones?
  2. Is it permitted to play music from a personal Premium Deezer account at the office on a Bluetooth speaker? There are three colleagues and no customers. Two of us have a Deezer account, and both would like to use the same speaker.

  1. as long as your office rules don’t prohibit it, I don’t see why not.
  2. playing personal music at work in an office with colleagues nearby is no different than playing music at the beach for friends.

Commercial use of a personal music streaming service like deezer generally involves using the music for financial gain or in a public setting where it is not intended, like in a business or for advertising. Examples include playing music in a restaurant, store, spa, or using it in a commercial video or advertisement. 

Note that I am not an official deezer representative or a lawyer, but I’m confident with my answers.

Thank you. I would say the same, but I have heard different opinions. The Terms & Conditions state that it is permitted only for personal use in a family environment. Strictly speaking, you can't listen to it on the street or on the beach.
It would be nice to have more precise conditions.

@vinkov perhaps in your region, your terms and conditions are different. I am in the US, where you wrote is incorrect.

 

From the US terms and conditions:

”The Recordings are protected by U.S. Copyright laws. Therefore, you may not use the Premium+ Service for any commercial purposes, including playing the Recordings in a business environment or public place. You may only access the Site, the Application and use the Premium+ Service for your own personal use.”

I am from Serbia, and here is a portion of our Terms & Conditions (translated into English):
The use of the Website and Deezer Premium Service, Deezer Family Service, Deezer Student Service, and Deezer Duo Service is permitted only for personal and private use. Therefore, any other use, especially in public institutions and businesses, is strictly prohibited.
Additionally:

The recordings available within the Deezer Premium Service are digital files protected by national and international copyright and related rights laws. Therefore, they may only be listened to in a private or family setting.
I’m not well-versed in legal matters, so I’m unsure whether I can even use the service at a bus stop with earphones, since that might not be considered a private or family space.
It would be helpful if someone from Deezer could clarify these doubts.

@vinkov I can assure you that you can use the service at a bus stop with earphones. You are focusing too much on the venue and not the intent of the ToS, which is to prohibit commercial use.

You listening to deezer at the bus stop on your earphones is not commercial use, it is private use in a public space. Same with being at the beach around friends, or your office example.

 You listening to deezer at your birthday party at home with friends over is not commercial use, it is private use in a private space. 

Conversely, you could be at home, in a private space, recording a YouTube video for publication, using music from deezer, and that would be a commercial use.

Commercial use is what is prohibited. The examples of locations listed in the ToS are all just examples of possibilities when using it commercially.

From your ToS: “Therefore, they may only be listened to in a private or family setting.” This means no commercial use in a restaurant, store, spa, or using it in a commercial video or advertisement (the examples I gave of commercial use).

Enjoy your music. The deezer police are not coming for you at the bus stop.

Thank you, ​@GropplerZorn. I'm sure the Deezer police won’t be waiting for me at the bus stop. 😆 But I must check for the office. One of our colleagues claims that the company could face a huge fine if we listen to any streaming service, regardless of whether we use private accounts. He planted that seed of doubt in me, and the more I read the terms and conditions, the more restrictions I seem to find.
