Terms and Conditions of Use

Article 1 – Deezer Community Site

The Deezer Community website, which is located at http://www.deezercommunity.com (hereinafter the “Deezer Community Site”), is operated by DEEZER S.A. (hereinafter “DEEZER”), a French corporation listed in the Trade and Companies Register under number 511 716 573, and whose registered office is located 24 rue de Calais 75009 Paris, FRANCE.

The Deezer Community Site offers a place for forums of discussion, for exchange of information and advices between users and moderators of the Deezer services, or for customer care services.  

The present terms of use (hereinafter the “Terms”) shall rule the access to and use of the Deezer Community Site by unregistered visitors (hereinafter the “Visitors”) and registered users (hereinafter the “Users”).

By using the Deezer Community Site, Visitors and/or Users agree to abide by these Terms. In the event any Visitor and/or User does not have the capacity to agree to these Terms (this means that he/she is not of the legal age required or is under any legal protection measure such as legal guardianship), such Visitor and/or User warrants that he/she has parental authorization or such authorization required from their legal guardian giving him/her the permission to use the Deezer Community Site.

Article 2 – Access and registration to the Deezer Community Site

2.1 – Limited use of the Deezer Community Site by Visitors

Visitors may only access the content that has been made available in public sections of the Deezer Community Site.

Visitors cannot publish content, nor interact with Users, DEEZER’s moderators, or DEEZER customer care service.

To get unrestricted access to all the content and features of the Deezer Community Site, Visitors have to register themselves by following the registration procedure as provided in Article 2.2 hereunder.

2.2 - Registration to the Deezer Community Site

In order to get unrestricted access to all the content and features of the Deezer Community Site, a Visitor must:

  1. login with their email address and password if he/she already has a DEEZER account, or create a DEEZER account on the page www.deezer.com;
  2. create a User name on the Deezer Community Site;
  3. read and accept these Terms.

if so desired, the User can also complete the specific profile settings information in the section “Settings” of the “My Profile” page of the User’s account on the Deezer Community Site.  

The User certifies the accuracy of the information given to DEEZER for his registration and agrees to notify DEEZER about any modification.

2.3 – Use of the Deezer Community Site by Users

Users of the Deezer Community Site shall be able to:

  • consult a forum, participate to a forum through posts, reactions and comments;
  • post images, links, and other content in the conditions set forth in these Terms.
  • interact with Users, DEEZER’s moderators, and/or DEEZER’s customer service through comments and/or private messages;

Article 3 – Moderation

3.1 – Content and information published by DEEZER

The content and information published by DEEZER on the Deezer Community Site are made available on an “as is” basis for information and customer care purposes only.

DEEZER will make every reasonable effort to regularly monitor and update the information and content it publishes on the Deezer Community Site and to verify its reliability.

Consequently, the information and content published by DEEZER on this Deezer Community Site are subject to change. DEEZER is not, however, in a position to guarantee the accuracy, adequacy, completeness or timeliness of the information and content published on the Deezer Community Site or to which it refers.

3.2 – Customer Care service

In case of sensitive or personal account questions, any User will be able to reach out to the DEEZER’s customer care service by (i) clicking on the tab “Help Center” of the Deezer Community Site, and (ii) submitting a request.

DEEZER’s customer care service will use reasonable endeavours to respond to such requests in a reasonable time frame but can make no guarantees or warranties of any kind that such requests shall be answered within a time frame corresponding to the User’s expectations, or that the answer shall be entirely satisfactory for such User.      

3.3 – Content and information published by Users

Visitors and Users acknowledge and accept that the Deezer Community Site is a public area in which Users are allowed to publish comments and various content and information, subject to the respect of these Terms.

Therefore, Deezer strongly recommends to Visitors and Users to:

  • never share any personal information on the Deezer Community Site, unless and only when they have been invited to do so by the DEEZER customer care through private messages;
  • be careful when clicking on a User’s posted external link, it might not be safe.

The DEEZER’s moderators may, at their sole discretion, move certain comments to a more appropriate heading, highlight a particularly relevant response, as well as close an inappropriate discussion and/or remove an inappropriate content.

Any User will have the opportunity to report to DEEZER any post he or she considers to be non-compliant with the Terms, by clicking on the “Flag” tab under said post.

Article 4 – Visitors’ and Users’ liability

  1. i) The User is solely liable for any messages, content, external link or information published by him on the Deezer Community Site. DEEZER is considered as an Internet service hosting provider only and cannot be held liable for the messages, content, external link(s), or information published by the Users on the Deezer Community Site over which DEEZER has no control or supervision at the moment of their publication.

So as to avoid being held liable, the User expressly agrees to ensure that any message, content, external link, or information published by him on the Deezer Community Site complies with the following (but  not limited) requirements:

Such message, content, external link, or information, shall not:

  • infringe any third party intellectual property rights; therefore, the User agrees not to publish content on the Deezer Community Site that is protected under copyright law, a registered trademark or more generally any content protected by any other intellectual property rights held by third parties without the prior consent of the owner or owners of the said rights;
  • contain any computer virus able to interrupt, destroy or affect the Deezer Community Site’s features; 
  • celebrate crime or criminal behaviour or contain illegal or threatening messages or content of a pedophile, pornographic, defamatory, obscene, hateful, racist, anti-Semitic, xenophobic, revisionist nature or contrary to public order and good manners; 
  • infringe the right to private life or promote disrespect for human dignity; 
  • encourage violence, fanaticism, crime, suicide, hate linked to religion, race, sex, sexual preferences, ethnicity; 
  • harass other Users; 
  • promote or encourage any criminal activity or enterprise; 
  • request, collect, and/or disclose any personal information of any User of the Deezer Community Site for any purposes; 
  • transmit email chains, mass unsolicited emails, instant messages, advertising messages and spam messages; 
  • contain any advertising and/or canvassing in order to offer products and/or services to sell through the Deezer Community Site; 
  • contain any addresses or Internet links transferring to external website whose content violates any law and regulation in effect, infringes third party rights or is in breach of the Terms.
  1. ii) The User agrees not to use any automated system such as scripts for the purpose of following Users, posting comments, and/or sending messages.

iii) The User is solely responsible for keeping his password safe and confidential; he further undertakes not to disclose his password at any time to any other User or use the account, name or password of any other User.

  1. iv) Should a Visitor or a User be in breach of the legislation or infringe any third parties’ rights, DEEZER would be within its rights to provide any information enabling or facilitating the identification of the offender at the request of any legal authority (courts, administrative authorities, and police forces).

Article 5 – Suspension and/or cancellation of a User’s account by DEEZER

Without prejudice to any damages that DEEZER may claim, DEEZER reserves the right to suspend access to the Deezer Community Site by a Visitor or a User and/or delete his account on the Deezer Community Site without notice nor compensation, in the event the Visitor or User does not comply with the Terms and especially: 

    • infringes the Intellectual Property rights of DEEZER or any third-party,
    • bypasses or attempts to bypass the technical measures of protection set up by DEEZER,                                      
    • uses multiple simultaneous connections to the same account or attempts to do so,
    • provides false information at the time of his subscription to the Deezer Community Site,
    • has activities prejudicial to DEEZER’s commercial interests.

Article 6 – Privacy Policy

6.1 Subject

This section reflects DEEZER’s commitment to protect the Visitors’ and Users’ privacy and personal data collected and processed when using the Deezer Community Site (the “Data”).

DEEZER undertakes to comply with the applicable legislation regarding the protection of privacy in relation to the processing of personal data.

6.2 Data collected

The Data collected and further processed are those:

  1. which are mandatory for either (a) the registration by Users to the Deezer Community Site or (b) the communications of such Users with the DEEZER’s customer care service. These Data involve as a minimum the User name, email address, and password;
  1. which are collected automatically while Visitors and Users use the Deezer Community Site, in particular technical data (such as the IP address of their computer or mobile device) and information relating to how they use the web-pages on the Deezer Community Site and its features, to the exclusion of any other data;
  1. which Users may voluntarily provide on the Deezer Community Site in the “Settings” section of their profile page (hereinafter the “Settings Page”);

6.3 Purpose of the Data processing

The Data collected through the completion by the Users of the mandatory fields is required to enable the Users to register to the Deezer Community Site and benefit from its features.

More generally, the Data provided by the Users (whether mandatory or not) and the Data automatically collected from Visitors and Users on the Deezer Community Site are processed in order to:

  1. personalize and improve the use by Visitors and Users of the Deezer Community Site,
  1. analyze and create statistics regarding the use of the Deezer Community Site,
  1. enable DEEZER to send email notifications to the Users’ e-mail address with respect to their activity on the Deezer Community Site (for instance to confirm the creation of their account of the Deezer Community Site, notify when another User replied on a feed they have subscribed to, or if they received a private message). If Users do not wish to receive email notifications, they can change their account settings at any time by clicking the “Settings” section on their profile page.

The Data may also be kept for security reasons, in order for DEEZER to comply with DEEZER’s legal and regulatory obligations.

6.4 Data recipients / sub-contractors

Visitors’ and Users’ Data will not be shared with third-parties without their express consent.

However, Visitors and Users are hereby informed that such Data may be disclosed pursuant to a law, a regulation, or a decision by a regulatory or competent legal authority or, if deemed necessary, for the purpose of preserving the rights and interests of DEEZER.

Visitors and Users (as applicable) are informed that DEEZER may also transfer Data to its following sub-contractors:

  1. The company inSided for the sole purpose of (a) the hosting and storage of the Deezer Community Site and the Data contained in it (b) the management of the Deezer Community Site operation, (c) the management of the processing and dispatching of DEEZER’s notifications to the Users.
  1. Where applicable, the company Zendesk for the sole purpose of (a) processing a User’s specific request by the DEEZER’s customer care service, and (b) send notifications from such service to such User.

6.5 Transferring the Data outside the European Union

Visitors and Users (as applicable) are informed that, as part of processing their Data, such Data may be transferred by DEEZER to companies’ servers located in a country outside the European Union, as follows:

The sub-contractor Zendesk’s servers are located in the United-States of America.

6.6 Data security

DEEZER attaches great importance to the security of the Data and takes all appropriate steps to minimize the risks of loss, damage or unauthorized use of this Data.

6.7 Data storage

The Data contained in the Deezer Community Site are stored only for the period of time strictly necessary to fulfil the aforementioned purposes.

6.8 Visitors’ and Users’ rights

Visitors and Users have the right to access, correct, and to delete their Data on request, by contacting DEEZER through the “Contact us” section of the Deezer Community Site, or by sending a letter to the following address: Deezer S.A., 24 rue de Calais 75009 Paris.

Article 7 – Data Collection Systems

This section provides information on Visitor’s and/or Users’ rights and preferences regarding Data Collection Systems.

A “Data Collection System” is a cookie, beacon, tag, invisible pixel or any other system capable of storing and/or collecting information about the navigation of a Visitor’s or User’s terminal equipment (computer, tablet, etc.) and/or his activity on the Deezer Community Site.

7.1. Who places Data Collection Systems?

Data Collection Systems may be placed either by Deezer, or by some of its subcontractors and/or partners.


Deezer and/or its subcontractor InSided only install the Data Collection Systems strictly necessary to the operation of the Deezer Community Site. These Data Collection Systems are used to notably memorize information relating to a User’s registration and/or connection, or Visitors’ and/or Users’ access to the Deezer Community Site and its features, to implement security measures or adapt the Deezer Community Site to a Visitor’s and/or a User’s device settings (language, operating system, etc.). These Data Collection Systems will also enable Users to access their personal settings on the Deezer Community Site.

Deezer, InSided, and Google Analytics may use analytical Data Collection Systems for the purpose of creating statistics regarding traffic and uses of the various components of the Deezer Community Site, to create studies in order to improve the Deezer Community Site and its features.

7.2. How can a Visitor and/or a User change their preferences?

At any time, a Visitor and/or a User can modify their preferences regarding Data Collection Systems.

In their browser settings, Visitors and/or Users can control whether Data Collection Systems are accepted or rejected on the Deezer Community Site, either occasionally or definitely. Visitors and/or Users should be aware these settings may modify their Internet browsing and their access to the Deezer Community Site and its features that require the use of Data Collection Systems, and Deezer accepts no responsibility resulting from the downgraded functioning of the Deezer Community Site and its features in the case a Visitor and/or User deletes Data Collection Systems necessary to the functioning of the Deezer Community Site.

Article 8 – Access to and availability of the Deezer Community Site

The Deezer Community Site can be accessed up to 24 hours a day and seven days a week, within the limit of the Terms and the terms of Article 5 here above.

In addition, DEEZER has the right, to temporarily remove access to the Deezer Community Site, without prior notice or compensation, where necessary to carry out maintenance due to technological developments or ensure continuity of the Deezer Community Site. DEEZER is also entitled to shut the Deezer Community Site down permanently with no compensation payable. Any permanent shutdown of the Deezer Community Site will be notified via the Deezer Community Site.

Article 9 – Disclaimer of Liability

The Visitor or User declares that he has been informed of the scope and limitations of the Internet network.

As a result, DEEZER disclaims all liability for any malfunction in accessing the Deezer Community Site, in the speed at which web-pages load, open and can be read, the temporary or permanent inaccessibility of the Deezer Community Site, and the fraudulent use by third parties of the information provided on the Deezer Community Site.

Therefore, it is the Visitor’s or User’s duty to protect his personal data and information or other equipment and hardware against any form of intrusion and/or virus contamination, for which DEEZER can never be held liable. DEEZER can never be held liable of any malfunction of or damage caused to the Visitor’s or User’s equipment.

More broadly, DEEZER disclaims any liability if a breach of any obligation results from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labour disputes, riots, insurrections, civil disturbances, shortages of labour or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or fluctuations in heat, light, or air conditioning and more broadly any unstoppable and unforeseen event which prevents orders being carried out successfully.

DEEZER disclaims all liability should it transpire that the Deezer Community Site is incompatible with certain items of equipment and/or features of the Visitor’s or User’s equipment.

The Visitor or User is solely liable for his use of the Deezer Community Site and cannot hold DEEZER liable for any claim and/or proceedings against him. The Visitor or User shall be responsible for any claim, complaint or objection and more broadly any proceedings brought against DEEZER by a third party in relation to his use of the Deezer Community Site.

Finally, DEEZER disclaims any liability regarding the use or inclusion by any User or Visitor of any external hyperlinks on the Deezer Community Site, and which may link to other websites that are not owned or controlled by DEEZER. DEEZER has no control over, and assumes no responsibility for any content, privacy policies, or any rules of third party websites and is not liable for any loss or damage which may be incurred by any User or Visitor as a result of the availability of any external resources through such external hyperlinks.

Article 10 – Intellectual Property

The general structure of the Deezer Community Site and all elements composing it (to the exclusion of content provided by Users) such as but not limited to the logos, domain names, and their associated elements such as but not limited to photos, images, texts, visual packaging of any elements, are the exclusive property of DEEZER and/or its licensors. These elements are protected by intellectual property laws. Users may access and use these elements for the purpose of using the Deezer Community Site, in accordance with the Terms.

Any use of all or part of the Deezer Community Site and/or the elements composing the same (as described above), by any means, without the express consent of DEEZER, is forbidden and shall be treated as tantamount to infringement which is punishable by law.

Any hyperlink to the Deezer Community Site and use of the “framing” technique (programming technique offering the possibility to divide browser windows into different independent frames in order to display the content of an external website) or the “in-line linking” technique (programming to make one element extracted from another site disappear into a web-page, which saves storage space on the hard drive where the Deezer Community Site is hosted and enables to hide the initial content of which the element is part from an uninformed user) is strictly prohibited.

Article 11 – Amendments of the Terms

DEEZER has the right to modify the Terms at its sole discretion. DEEZER will inform the User via email to the address given on the User’s account, of any amendments of the Terms at least 2 (two) months before they come into effect.

Where the User does not accept these modifications, he will be free to cancel his account on the Deezer Community Site as set forth in Article 6.8 above.

Article 12 – Invalidity of any clause

Should any of the clauses of the Terms be declared void or voidable for any reason, the other clauses will still apply without any modification.

Article 14 – Jurisdiction – Claims and disputes

The Terms are governed by the law applicable to the defendant.

Any claim relating to the application of these Terms of Use must be emailed to the DEEZER’s customer care service by clicking the link http://www.deezer.com/support, or sent by post to Deezer – Customer Care Service – 24 rue de Calais 75009 Paris, for prompt processing.

In case of a dispute, the parties shall try to reach an out-of-court settlement. If no settlement can be reached, any claim regarding the validity, interpretation and/or execution of the Terms must be referred to the court in the jurisdiction of the defendant’s country of residence.
